Terms & Conditions
Please read the following Terms and Conditions carefully.
By enrolling on our Laser Safety Training programmes, you accept our Terms and Conditions, Intellectual Property, and Non-Disclosure Agreement as detailed below.
As a small business, we strive to provide professional service and remain flexible with advance notice, but certain policies are necessary to ensure smooth operations and protect the work we have undertaken to provide this service to you.
The following terms and conditions apply to all training and consulting situations.
Beam Safe Industrial Laser Safety Training Ltd are not responsible for processes performed by Learners after theory training, as equipment varies and guidance should come from manufacturers.
We reserve the right to refuse training if a minimum of English language requirements are not met. (eg: our training is offered in English only at this stage)
Acceptance of our Intellectual Property and Non-Disclosure Agreement is required. Our materials are protected by copyright, and any breaches may result in legal action.
We routinely conduct due diligence on Learners and Industry entities. The agreement is binding and prepared by Lucy Hudson of Woodhouse IP Ltd.
For the purposes of this Agreement, all individual courses may collectively be referred to as “Training Programme” Our staff and administration team are available to contact during business hours and will endeavour to respond to calls or emails and mark or move you through modules as soon as they are available to do so. We understand that unforeseen circumstances may arise, so please contact us immediately so we can assist where possible.
COURSE ENROLMENT: Learners who are enrolled in courses but fail to access, commence, and/or complete their course curriculum within the set study period will be disconnected from the learning platform after receiving our email reminders. Learners enrolling in online courses will be sent login details within 24 hours of booking on business days and the next commencing business day following weekends or public holidays. Logins are issued to individual learners only and must not be shared with anyone else. Courses are theory-based and delivered via our e-learning platform, Litmos, which is available 24/7 anywhere in the world on a tablet, Laptop, PC (ideal), or mobile device. For any technical issues, password resets can be requested via the Learner Support Ticket Request link in the footer of our www.lasersafetytraining website.
PRE-REQUISITES: Learners must check the pre-requisites for training programmes before enrolling to ensure they are eligible. (eg: Safe Use of Lasers in the Workplace or Laser Safety Certificate for Laser Cleaning before enrolling in Laser Safety Officer Certificate (LSO).
EXTENSIONS: For selected training programmes, learners can request a free 2-week extension before or on the expiry date. A second extension can be requested for 7 days for a fee of $100 + GST, then a final third extension can be requested for 7 days for a fee of $100 + GST. If your programme has been paid for by a supplier of your laser equipment, do not assume they will pay this fee for you.
FEES, PAYMENTS & PRICING
COURSE FEES: Are as stated on our website or as per the quote provided. We reserve the right to change training programme offerings and prices at any time. Training programme fees are required in full at the time of enrolment unless otherwise arranged by management. If your training programme has been booked through a quote, via our website or Litmos, it will be charged to your Credit Card via a payment gateway. (Fees may apply via your bank's/payment gateway's charging policy). If it is booked via a booking form, an invoice will be sent to you to secure your place on the chosen training program. The exception is larger franchised businesses with 20th-of-the-month pre-approved accounts.
Where applicable only: BUY NOW, PAY LATER FINANCE OPTIONS: Payment options such as After Pay, Klarna, Q Card or similar are provided by third-party providers and are subject to their own terms, conditions, eligibility criteria, fees, and approval processes. Beam Safe Industrial Laser Safety Training Ltd has no control over, and accepts no responsibility for, decisions made by these providers. Learners are responsible for ensuring they understand and comply with the applicable repayment obligations. Please note: A surcharge fee of approx. 4.5% applies if you choose Q Card finance as your payment method. By selecting Q Card, you agree to this fee in addition to the training programme cost. This fee covers administrative costs associated with processing the transaction. We advise all customers to carefully consider this additional cost before opting for financing.
ASSESSMENT, CERTIFICATION & ZOOM
ONLINE ASSESSMENT: Assessments vary between training programmes; this may be open-book or closed-book. Learners will require a minimum pass mark of 80%. Assessment techniques vary by course. For end-of-course assessments, if a learner fails, a free resit is included; after that, a $50 + GST fee applies. Up to 2 more resits are allowed after a free attempt, or the trainer may issue an incomplete or fail status, which may result in no certificate. Learners understand that further training may be necessary, and completing theory-based training doesn't guarantee full certification in laser devices.
CERTIFICATION: Beam Safe Industrial Laser Safety Training Ltd certifies understanding of laser science, hazard awareness, and safe use of lasers, not device-specific certification. Additional device training should be sought from the manufacturer or supplier.
CERTIFICATES: Electronic certificates are issued either online at the end of the programme, or within 2 weeks. Hard copies are available for a small fee.
LASER SAFETY AWARENESS BRIEFING ZOOM SESSIONS: The company or individual learners in Zoom sessions must have a working webcam for the trainer/Laser Safety Officer to see them; virtual backgrounds are not allowed. An electronic certificate is issued to the individual or company upon completion of the laser safety briefing session, provided full payment has been made. This is also pending full participation. Please note: Laser safety briefings are not considered laser safety training for operators; they are purely informational.
WORKPLACE SAFETY DISCLAIMER
All laser workplaces should obtain legal advice to confirm insurance coverage for laser use and fully understand their responsibilities under the Health & Safety Act.
Beam Safe Industrial Laser Safety Training Ltd has taken reasonable steps to ensure that all information is accurate and current at the time of programme creation or consultancy. We strive for accuracy in our courses, consultancy, and materials, but are not liable for any loss, damage, costs, or expenses that may arise because of failure to meet legal requirements pertaining to laser. This includes anyone who purchases courses, uses consultancy services, or receives resource or guidance materials from us directly or as part of their training service.
Beam Safe Industrial Laser Safety Training Ltd recommends that laser workplaces consult a qualified professional to advise on technical specifications such as MPE, nominal hazard distances, extraction and ventilation systems, and/or occupational disease prevention and information, as these topics fall outside the scope.
Beam Safe Industrial Laser Safety Training Ltd also recommends consulting: the company that sold the laser, a qualified Health & Safety expert in your field (e.g., Fire Safety Officer), an occupational hygienist (for occupational disease prevention and information) and or, where relevant, a laser physicist for high-powered lasers that risk eye or skin damage.
SERVICES, CHANGES & REFUND POLICY
CHANGES/POSTPONEMENTS AND REFUNDS POLICY: Beam Safe Industrial Laser Safety Training Ltd may be required to change dates, cancel training, or postpone sessions. Notice will be given if it affects bookings.
All courses are non-refundable once content beyond the IP agreement has been accessed online. In certain cases, if access has not been activated, we may allow the transfer to another learner at no charge or issue you with a credit note. Consulting service is non-refundable if cancelled within 5 working days; for bookings made in the Auckland area - should Beam Safe Industrial Laser Safety Training Ltd not be able to attend your workplace, an alternative date or virtual session will be offered.
We do not provide refunds if the course content has been accessed but not completed within the enrolment period. In the case of a course cancellation, and only where applicable, any hard copy materials issued shall be returned to Beam Safe Industrial Laser Safety Training Ltd at your expense.
Refunds/credits are valid for 12 months; after which, unused credits expire.
SICKNESS / BEREAVEMENT: Learners must contact Beam Safe Industrial Laser Safety Training Ltd immediately to advise if they are unwell or have a bereavement and are unable to complete their training and may be asked to provide a doctor’s certificate to validate an extension beyond the permitted time.
ONSITE & ZOOM SERVICES CANCELLATIONS: We are happy to re-book your scheduled training or safety briefing service with 48 hours' prior notice with no fee; however, if flights or travel arrangements required to deliver this service incur fees for changes, these will be passed on to you.
Please note that additional charges apply for in-person consultancy or theory training outside Auckland. We pass on the cost of: flights, accommodation, car hire, parking, or cancellation fees, as per the provider's booking policies.
COMPLAINTS: Beam Safe Industrial Laser Safety Training Ltd values concerns as feedback to improve our service. We are committed to an efficient, fair, and confidential complaint process. This process addresses issues such as delays, lack of response, discourtesy, lack of consultation, and service standards. The complaint process is available on the website footers for Beam Safe Industrial Laser Safety Training Ltd.
Intellectual Property (IP) and Non-disclosure Agreement
Please read the following Intellectual Property and Non-disclosure Agreement.
This document acts as a written agreement that the Learner will not copy, use, replicate or disseminate any of Laser Safety Training, which is affiliated with Beam Safe Industrial Laser Safety Training Ltd Intellectual Property. Signing this Agreement acknowledges that failure to abide by the terms and provisions of this Agreement may result in *1 legal prosecution and immediate removal from the educational programme, and that this will affect the Learner’s ability to access, be certified in, register for or hear about industry events in the future.
I hereby acknowledge and agree that, in consideration of my enrolling in an Educational Programme of Laser Safety Training, Beam Safe Industrial Laser Safety Training Ltd:
“Educational Programme” is a programme or course offered by Beam Safe Industrial Laser Safety Training Ltd and includes, but is not limited to: Laser Safety Awareness Briefing, Workplace Basic Laser Safety Certificate, Safe Use of Lasers in the Workplace, Laser Safety Officer Certification, Basic Safety Certificate for Laser Cleaning, Basic Safety Certificate for Laser Welding and additional courses found under the “Training” tab on Laser Safety Training website www.lasersafeytraining.co.nz.
Laser Safety Training is affiliated with Beam Safe Industrial Laser Safety Training Ltd, which is the sole owner of all the intellectual property rights in the Educational Programmes, including copyright, trademarks, trade secrets, know-how, documentation (hard copy and digital), graphics, data, software, ideas and inventions (“Intellectual Property Rights”).
Access to any Educational Programme does not include transfer of any Intellectual Property Rights to me, the Learner.
Educational Programme materials provided to me as part of my enrolment in an Educational Programme can only be used by me for personal use and for the sole purpose of attending and completing the Educational Programme and may not be copied, distributed to third parties, or used for any other purpose (including internal staff training), and must be returned to Beam Safe Industrial Laser Safety Training Ltd for updating upon request.
Every Educational Programme is a commercially valuable product which is only available under licence from Beam Safe Industrial Laser Safety Training Ltd.
I will promptly notify Beam Safe Industrial Laser Safety Training Ltd of any actual, threatened or suspected infringement of the Intellectual Property Rights or any claim that any Educational Programme infringes the rights of any other person.
I agree not to provide, and that I do not currently provide, or work for any educational, tutoring or training services for a period of 5 years following my attendance in this Educational Programme.
If you do now, or intend to, we may send you an additional waiver to sign.
This applies whether as an individual or as part of the services of an organisation that compete with any Laser Safety Training offered by Beam Safe Industrial Laser Safety Training Ltd Educational Programme (including but not limited to Laser Safety Awareness Briefing, Workplace Basic Laser Safety Certificate, Safe Use of Lasers in the Workplace, Laser Safety Officer Certification, Basic Safety Certificate for Laser Cleaning, Basic Safety Certificate for Laser Welding and additional courses found under the “Training” tab on Laser Safety Training website www.lasersafeytraining.co.nz.
* Beam Safe Industrial Laser Safety Training Ltd employs the services of Lucy Hudson, Intellectual Property Lawyer of Woodhouse IP Ltd.
** By signing this Intellectual Property and Non-Disclosure Agreement, you (the Learner) are accepting this Agreement with your enrolment. Should you have any questions, you can contact us directly.
** In the absence of a signed copy of the Intellectual Property and Non-disclosure Agreement, and electronic enrolment form by ticking you ‘Agree to the Intellectual Property and Non-disclosure Agreement’ on the electronic website enrolment form – you are hereby agreeing to the above IP Non-disclosure Agreement and are agreeing to the above Terms and Conditions.
